These Terms of Service (“Terms”) explain the rules for using the services run by Motion Media (“Motion Media,” “we,” “us,” or “our”), founded by Joshua Thillens. Please read them. They are written to be readable, but they are still an agreement between you and us.
1. What these Terms cover
These Terms apply to:
- Motion Media News at motionnews.studio: articles and analysis on defense, AI, robotics, geopolitics, and US politics.
- Motion Terminal at terminal.motionnews.studio: a live news wire that collects original headlines from news outlets and links out to the publishers, along with user votes, view counts, and a global chat.
We call these together the “Services.”
2. Accepting these Terms
By using the Services, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Services.
3. Who can use the Services
You must be at least 13 years old to use the Services. If the law where you live requires you to be older to agree to these Terms on your own, you must be that age or have permission from a parent or guardian.
4. Accounts and signing in with X
- How to sign in. Motion Terminal’s main sign-in option is your X (Twitter) account. You can also sign in with an email address as a backup.
- Preview for visitors. If you aren’t signed in, you get a limited preview (5 article clicks or 5 minutes). After that, we’ll ask you to create a free account to keep going.
- Your responsibility. You’re responsible for your account and for what happens under it. Keep your X account and email secure, and tell us if you think someone else is using your account.
- X’s rules apply too. When you sign in with X, X’s own terms and policies also apply to your X account. We don’t control X.
- Accurate information. Don’t create accounts using someone else’s identity or false information.
5. Free accounts and possible paid plans
Accounts are free today, and we don’t charge you anything. We may offer paid plans in the future through our payment provider, Stripe. If we do, the price and billing terms will be shown to you at checkout before you pay, and we will update these Terms. Nothing here allows us to charge you without your clear agreement.
6. Acceptable use and chat rules
We want the Terminal and its chat to be a useful place to talk about the news. When you use the Services, you agree not to:
- Harass, bully, threaten, or intimidate anyone.
- Post hate speech or attack people based on who they are.
- Spam, flood the chat, or post misleading promotions or scams.
- Post illegal content, or encourage illegal activity.
- Share someone’s private or identifying information without their permission (doxxing).
- Impersonate another person, outlet, or organization.
- Scrape, crawl, or copy the Services with bots or automated tools, manipulate votes or view counts, or otherwise abuse or overload the Services.
- Try to break into, disrupt, or get around the security or limits of the Services (including the visitor preview).
We may remove content, limit features, or suspend or close accounts that break these rules or that we reasonably believe put other users or the Services at risk.
7. Your content
“Your content” means things you post or create in the Services, such as chat messages and votes.
- You keep ownership of your content.
- You give us permission to use it in the Services. By posting, you grant Motion Media a non-exclusive, worldwide, royalty-free license to host, store, display, and share your content as part of running and improving the Services. This license ends when your content is deleted from the Services, except where it has already been shared or we need to keep it for legal reasons.
- You’re responsible for it. Only post content you have the right to post.
8. Third-party news content
Motion Terminal shows headlines from other news outlets. Those headlines, and the articles they link to, belong to their publishers. We show the original headline and link to the publisher’s own site so you can read the full story there.
If you are a publisher and want your feed removed from Motion Terminal, contact us (see Section 16). We will act on removal requests within 24 hours.
We aren’t responsible for the content, accuracy, or practices of third-party sites we link to.
9. Not advice
Content on the Services is for general information only. It is not financial, investment, legal, or military advice. Don’t make decisions based only on what you read here. Talk to a qualified professional when you need advice.
10. News accuracy and opinion
We work to be accurate, but news moves fast and mistakes happen. Articles, headlines, and live wire items may contain errors or become outdated. Pieces labeled as opinion or commentary reflect the views of their author, not necessarily those of Motion Media.
11. Our content
Apart from your content and third-party content, the Services and their content (including our articles, design, logos, and software) belong to Motion Media or its licensors. You may read and share links to our content, but don’t copy, republish, or sell it without our permission, except as the law allows.
12. The Services are provided “as is”
We provide the Services, including free accounts, “as is” and “as available.” To the fullest extent the law allows, we don’t make promises or warranties about the Services, including that they will always be available, error-free, secure, or fit for a particular purpose.
13. Limitation of liability
To the fullest extent the law allows, Motion Media and its founder will not be responsible for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Services. For free use of the Services, our total liability to you for any claim is limited to US $100. Some places don’t allow these limits, so they may not fully apply to you.
14. Ending your use
You can stop using the Services and ask us to delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the Services. Sections that by their nature should continue (such as ownership, disclaimers, and limitation of liability) will keep applying after your access ends.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll post the new version on this page with a new effective date. If the changes are significant, we’ll make reasonable efforts to let you know. If you keep using the Services after changes take effect, you accept the updated Terms. Any disputes will be handled under applicable law.
